General conditions of online sales for the purchase through the website www.bormioterme.it

Bormio Terme Spa, based in Via Stelvio 14, 23032, Bormio (SO), VAT registration number 00062420146 (from below "the Seller"), makes available for all the users the possibility of purchasing online its producs, packages and service through its website: www.bormioterme.it; this kind of sale belongs to the distance selling's field and it's regulated as such. 

1) General conditions

The present general selling conditions are applied exclusively to the online sale of products, packages and services identified and enlisted under the heading: “Shopping and gifts” and “Buy it online”.

The customer (from below "the Customer") is asked to print and retain the present general conditions.

2) Offer to the public

Products, packages, services and the related prices represent an offer to the public. The purchase agreements concluded on the website are stipulated with Bormio Terme Spa.

3) Prices

All the prices of the goods and services shown online have to be intended VAT-inclusive. Bormio Terme retains the right to change in every moment and with no notice, the prices of the online products and services as well as change either eliminate at its own discretion goods, products or services from its online catalogue. 

4) Order

Purchase orders have to be done online following the order procedure on the website under: “Shopping and gifts” and “Buy it online”.

The filling of the order by the customer needs to be done following one of the procedures below:

• In case the customer is already registered on the website he just needs to use his credentials and log in.
• In case the customer hasn't yet been registered he needs to use the form "Host user without registration". 

The customer completes the order process if the website doesn't show any error message.

The purchase agreement has to be intended as finalised when Bormio Terme receives the order; at the end of the procedure the Seller's informatic system confirms, in real time, the registration of the order sending an email to the Customer including: order number, date, total amount and, in case the chosen payment has been the credit transfer, the bank details to make the payment.

5) Payment and order dispatch

The payment can be done online via credit card or bank transfer. The order will be dispatched after the acknowledgement of the payment.

6) Delivery

The order will be ready in 1 or 2 working days on average. The delivery time goes from 3 to 5 working days. The shipment can be done in Italy only, with costs to be borne by the recipient, through express courier; the goods' journey is at customer's risk, and in no case Bormio Terme will be held responsible in case of shipment delays.    

The shipping fees are properly highlighted during the order process.

At the moment of the pick up the Customer need to verify the integrity of the goods and the correspondence of the parcel with the expected one.

The signature on the delivery paper counts as a formal acceptance of the goods from the Customer. Any complaint should be raised straight away to the courier, otherwise the parcel will be considered as regularly delivered.

7) Right of withdrawal

E-commerce activity is assimilated to the long distance selling therefore according to the art.64 of the Consumer Code the Consumer has right to withdraw without any penalty and with no reason in the next ten (10) working days. 

"Consumer" to be intended as any natural person that, relating to the contract, acts for purposes external to his own professional activity. Therefore the right of withdrawal decades for the legal persons and for the natural persons who act in the course of their work.

The term to exercise the right of withdrawal begins from:

• For goods, from the date of receipt of the Consumer;
• For services, from the day the agreement has been sealed;

The right of withdrawal is exerted sending, in the terms above, a registered mail addressed to:

The notification can be also sent, by the same deadline above, via telegram, telex, mail or fax with the only condition that it will be confirmed by a registered mail sent in the next 48 hours. For what it concerns contracts regarding the supply of goods the integrity of the product is an essential condition for exercising the right of withdrawal. The consumer is due to pay the shipping fees necessary to return the product. Bormio Terme will refund the consumer the amount indicated in the original order (net of the cost of the first dispatch).

8) Warranties

Bormio Terme Spa offers warranty in accordance with the law toward both the consumer and the non-consumer client. 

9) Communications

10) Competent court

Eventual disputes related to the interpretation or execution of the present general conditions or the contract, arising from an online purchase will be exclusively solved by the court of Sondrio or according to the regulation established by the Consume Code in favour of the consumer.
